Waiver Notice: Summer of 2022 and the 2022-23 SY

The New York State Education Department has requested State-level waiver authority from the United States Department of Agriculture (USDA) to approve the following operational flexibilities that may be needed to respond and recover from the COVID 19 pandemic during the Summer of 2022 and the 2022-2023 school year. Once authorized, SED will provide guidance to operators on requesting and using the waivers.

SFSP Rescinded Waiver Approvals

 

The New York State Education Department (SED) has received approvals for the following four waiver requests submitted to the United States Department of Agriculture Food and Nutrition Service for rescinded policy waivers as issued in SFSP 01-2019, Summer Food Service Program Memoranda Rescission, October 11, 2018.* 

Offer versus Serve: allows use of the SFSP Meal Pattern for all sponsoring organizations in good standing.

Fruit Fresh Up, Inc. is voluntarily recalling from the market all fresh cut fruit and vegetable products and ready to eat dips, as listed below, processed at its Depew, NY production facilities, due to a possible health risk from Listeria monocytogenes.

NYSED Announces the Availability of the 2022 Summer Food Service Program

The New York State Education Department (NYSED) encourages public and nonpublic nonprofit school food authorities; local, county, municipal, and state governmental entities; Indian tribal territories, migrant programs; nonprofit agencies; faith-based organizations and camps interested in providing healthy meals to children this summer to participate in the United State Department of Agriculture’s Summer Food Service Program (SFSP).

To file a program discrimination complaint, a Complainant should complete a Form AD-3027, USDA Program Discrimination Complaint Form which can be obtained online at: https://www.usda.gov/sites/default/files/documents/ad-3027.pdf, from any USDA office, by calling (866) 632-9992, or by writing a letter addressed to USDA. The letter must contain the complainant’s name, address, telephone number, and a written description of the alleged discriminatory action in sufficient detail to inform the Assistant Secretary for Civil Rights (ASCR) about the nature and date of an alleged civil rights violation. The completed AD-3027 form or letter must be submitted to USDA by:
